Damages victory for boy whose father was killed in collision

24 October 2009

A boy whose father was killed in a road accident has been awarded £180,000 damages for his loss.

The father of the young boy - who cannot be named for legal reasons - sustained a fatal head injury when the car in which he was a passenger, crashed.

"Any case where a child loses a parent in this way is tragic," said Martin James, a personal injury specialist with Fentons who represented the boy. "As the boy's mother was unable to make a claim for dependency, we pursued the claim on behalf of her son."

The case involved making representations to the court regarding what kind of a father the man was, and the impact his death would ultimately have on the boy.

"The case was largely built through witness evidence from employers, friends and family about how much he cared for his son and how hard he worked," said Martin. "Following lengthy negotiations, the claim was settled for £180,000.
